On Monday, we reported that the city of San Jose, California was considering joining a “friend of the court” brief opposing Prop 8. The report suggested that “budget constraints prevent San Jose from preparing its own brief” but the city can join another party’s brief.
On Tuesday, the San Jose City Council voted in favor of being included on the brief, which, according to reports, is the same brief that will be filed by San Francisco.
The case is Hollingsworth v. Perry, and oral arguments at the Supreme Court will be held March 26.
In Edith Windsor’s challenge to Section 3 of the Defense of Marriage Act, United States v. Windsor, the Bangor City Council voted for the city of Bangor, Maine to sign on to an amicus brief urging the Supreme Court to strike down the law. The brief will be filed by “cities and large employers” including “Boston, Los Angeles, New York and Seattle, and large employers, such as Google, Zynga, Starbucks and Microsoft”.
Oral arguments in the Windsor case are on March 27.
