No decision today in New Jersey marriage equality case

Arguments in trial court in New Jersey have just concluded. EqualityOnTrial’s own Jacob Combs attended, and he is reporting that there was no decision issued today in the case. The challenge is Lambda Legal’s lawsuit against New Jersey’s ban on marriage equality after the state supreme court’s 2006 decision holding that same-sex and opposite-sex couples should receive the same benefits. This is also the first opportunity for New Jersey courts to decide the state of the law post-Windsor. In Windsor the United States Supreme Court struck down Section 3 of the federal Defense of Marriage Act, and in the process nullified many rationalizations for banning marriage equality.

The judge is allowing additional briefing, due by August 28, and he said not to expect a decision before September, at the earliest.
