New Jersey Supreme Court takes up marriage equality case

The New Jersey supreme court has agreed to hear Garden State Equality v. Dow, the marriage equality challenge. Both sides supported direct review of the case, as opposed to appeals that could have lasted awhile even on an expedited schedule. The order from the state supreme court sets a schedule for briefing and argument that would have oral arguments taking place in early January. The opening brief is due November 4.

The state supreme court also wrote that it has jurisdiction over the request for a stay in the case, and their decision on the stay will come down on the same schedule as before, meaning that the plaintiffs’ opposition to the stay will be filed next Tuesday, October 15, and a decision on the request would be issued after that.
