The same-sex couples in the Ted Olson and David Boies-led challenge to Virginia’s same-sex marriage ban have filed their response brief in the case. The briefs respond to earlier ones filed by Clerks Schaefer and McQuigg.

    VI. The Court should stay the mandate pending review by the Supreme
    Court.
    The trial court was correct to stay its injunction pending appeal, and this
    Court should likewise stay the mandate pending review by the Supreme Court.
    Fed. R. App. P. 41(d)(2).

    I've got to say, I'm surprised by this.

    Partiularly when it is followed by this:

    There is no need to create such uncertainty when the issue can be definitively resolved in the Supreme Court’s 2014-15 term.

    To me that is a strong statement. He is stating there is no urgency in this matter.

    That is from page 58 of Herring/Rainey's brief that was posted on 4/11. So many briefs, sorry for the confusion.

    Scottie, if you check way down on the comments to the posting of the Third Brief in Bostic v. Scheffer, you will see that the person who posts as Ragavendran was kind enough to post both the Olson-Boies brief (above) and the Paul Smith-ACLU-Lamba Legal brief on behalf of the intervening class action plaintiffs.

    I agree that the Rainey brief (filed by the AG) is the best of the three. It comes close to, if not matching/exceeding, the succinct eloquence and strength of Judge Wright Allen's opinion.
