Durango: Marriage Equality Up-Date, More Amparos

We are preparing a collective amparo and an amparo by legislative omission, both against the Congress of Durango. They cannot be ignored nor continue with discriminatory, lgbt-phobic, and stigmatizing acts. Unfortunately, Durango is shaping up to be the last-in-line in recognizing marriage equality.

I know that a large part of Chile will be expectant today, Tuesday, because at 3:00 PM the Senate will vote on marriage equality, and if approved, marriage for persons of the same sex will be law. Happy to see that little by little we advance in matters to erase discrimination!
There were to be two votes today, the first occurring in the Senate Constitution Committee at 10:30 AM, and the second in the Full Senate at 3:00 PM, . . . BUT . . .

Now. Marriage equality paused due to discrepancies of the Senate Constitution Committee on 4 or 5 articles. Monday, it will be seen in the Mixed Commission, and Tuesday, it will go to a vote in the Full Senate for its final vote. The votes are there to approve it.

Yes, Monday, 6 December 2021, at 10:30 AM, in the Mixed Commission, and then on Tuesday, 7 December, for a final vote in the full Senate.

The Full Senate approved the Report from the Constitution Committee that proposed to reject 6 norms and to approve the other remaining 9 of the marriage equality bill. The Mixed Commission will resolve the differences next week.

Canada: Federal Bill to Ban "Conversion Therapy" Re-Introduced
Per LGBT Marriage News:
Today, 30 November 2021, the federal government introduced legislation in Parliament, titled Bill C-4, to ban "conversion therapy" in Canada. Similar legislation introduced earlier this year was lost when the recent election was called.
However, the new legislation appears to be stricter and more comprehensive than the version that was lost with the dissolution of Parliament before the election. The new version would make "causing another person to undergo conversion therapy" a criminal offense.
The previous version, known as Bill C-6, called for a criminal penalty only if "conversion therapy" were performed on an adult without consent. The change suggests that no person will be allowed to participate in "conversion therapy" if the bill becomes law, regardless of consent.

Canada: House Unanimously Passes Bill Banning "Conversion Therapy"

On 1 December 2021, only one day after Bill C-4 had been re-introduced, in a rare moment of non-partisanship, the Government obtained unanimous consent from the House of Commons to pass said bill banning anti-LGBT "conversion therapy" at all stages. The measure has now been sent to the Senate.

Tamaulipas: Federal Judge Forcing State Congress to Approve Marriage Equality

El juez Federal, Advento Hernández Reyna, titular del Juzgado Décimo de Distrito en Tampico, está obligando al Congreso de Tamaulipas al cumplimiento de la sentencia 88/2021 que otorgó un amparo declarando inconstitucionales los Artículos 124 y 132 del Código Civil estatal por violar la garantía constitucional de igualdad y libre desarrollo de la personalidad, al impedir el matrimonio entre personas del mismo sexo, especificamente para una pareja de Tampico.

Federal judge, Advento Hernández Reyna, head of the 10th District Court in Tampico, is forcing the Congress of Tamaulipas to comply with sentence 88/2021 that granted an amparo declaring Articles 124 and 132 of the state Civil Code unconstitutional for violating the constitutional guarantee of equality and the free development of personality, by preventing marriage between same sex couples, specifically for a couple from Tampico.
This recent federal court ruling against the state Congress of Tamaulipas is at the same level of severity as were the federal court rulings against the state congresses of Sinaloa and Sonora, both of which led to the quick passage of the required marriage equality legislation in those two states. In addition, the state of Tamaulipas remains under direct Supreme Court orders to do likewise.

Tennessee: "Christian" Adoption Agency Sues HHS over Non-Discrimination Rules
A foster agency in Tennessee is suing the Biden administration, saying that its religious freedom is being violated because they do not wish to place children with LGBTQ parents. The Holston United Methodist Home for Children filed a lawsuit in federal court yesterday, 2 December 2021, against the Department of Health and Human Services (HHS), alleging that the Department’s rules that ban discrimination on the basis of sexual orientation in foster programs that receive federal money violate their rights. The Trump administration's "religious exemption" is no longer being granted by HHS, while those exemptions that had been granted, have been revoked. As a result, Holston is feeling intense "butt-hurt."
While Holston says that it believes it’s in the best interests of the child to be placed in a Christian home headed by a married, heterosexual couple, it does not actually argue that point so much in the lawsuit, possibly because it knows that the facts are not on its side. Instead, Holston’s lawsuit is only about its own rights as an organization under the First Amendment of the Constitution, as well as under the Religious Freedom Restoration Act (RFRA), rights which it claims are being violated because it can not deny kids homes and still keep its HHS grant.
The anti-LGBTQ hate group Alliance Defending Freedom is representing Holston.

Grinning Trumpanzee Seen Toting Pelosi's Lectern Pleads Guilty
Adam Johnson, 36, pleaded guilty in Washington federal court to one count of entering or remaining in any restricted building, according to court records. Federal prosecutors have agreed not to seek prison time for the Parrish [Florida] man, but a judge will make a final decision at a hearing scheduled for Feb. 25.
A plea agreement recommends that Johnson pay $500 restitution for his share of the damage. Prosecutors have said the riot caused nearly $1.5 million in damage to the U.S. Capitol.
Authorities say Pelosi’s offices were among those breached by the mob objecting to Democratic President Joe Biden’s election victory over former Republican President Donald Trump. Five people died in the violence.
A photo that circulated around the world after the violent uprising showed a grinning, waving man identified as Johnson carrying the lectern through the Capitol rotunda with the clearly visible words “Seal of the Speaker United States House of Representatives.” Johnson is wearing a knit cap that says “Trump” on it.
