Golinski v. OPM (currently being appealed at 9th Circuit)

Today, the DOJ filed its opening brief.

But in a rather dramatic development, the DOJ has asked the U.S. Supreme Court to take the case before the 9th Circuit issues its judgment.  Read notice to court and petition here.

    I haven't read the filings, but this strikes me as quite an unusual move. I have no idea *how* unusual, though.

    According to the filing, it's unusual but not unprecedented. Several precedents are cited.

    What's truly strange is that ScribD insists that the content of the filing includes material which may be suitable only for adults and asked whether I was sure I wanted to continue (of course I said yes). I wasn't aware that court filings could be x-rated.

    Yeah, sfbob. Suddenly Scribd started flagging my uploads today as "adult." I'm trying to get it resolved, but not sure if I'll hear back before end of holiday.

    If anyone has an "in" with Scribd, let me know. It's MOST annoying!

    I thought it was sort of fun/funny and evoked curiosity to see what could possibly be considered "Adult Content"…and true to how some haters treat us as pornographic "don't expose the kids" (to love, caring, reality)
