BLAG Files Appeal Pedersen Decision with Second Circuit

BLAG appeals the district court decision striking down DOMA in the Pedersen case to the Second Circuit Court of Appeals.  The Justice Department appealed the case to the circuit court in August, and both the plaintiffs and the DOJ filed petitions asking the Supreme Court to review the case before Second Circuit.

Both the Justice Department and BLAG contest each other’s legal standing to appeal the decision in Pedersen and the other DOMA Section 3 cases.  BLAG argues that the DOJ has no standing since it supports the district court decisions striking down DOMA.  The Justice Department argues that BLAG and the House of Representatives have no standing on their own to appeal the cases, since it is the executive branch’s responsibility to defend laws passed by Congress.
