Darby/Lazaro court denies anti-gay group’s motion to intervene

Cook County Circuit Court Judge Sophia Hall denies the motions to intervene filed in the Darby/Lazaro case by the Illinois Family Institute (IFI) and two churches, the Church of Christian Liberty and Grace-Gospel Fellowship.

In her opinion, Judge Hall writes, “A decision on the constitutionality of the ban on same-sex marriage in the IMDMA [Illinois Marriage and Dissolution of Marriage Act] provisions before the Court will not affect the Churches’ existing right to decline to perform any marriage.” ¬†Furthermore, she writes, “the Churches … have no interest greater than that of the general public.” ¬†Similarly, Judge Hall rules that IFI “has no interest greater than the general public, nor has it shown that it would gain or lose by the direct legal operation and effect of a judgment in this suit.”

Judge Hall does allow both churches and the IFI the opportunity to file amicus¬†curiae briefs in support of the two county clerks defending Illinois’s ban on marriage equality.
