Hawaii governor tells Ninth Circuit he supports parallel scheduling of Jackson/Sevcik
December 12, 2012
Hawaii Governor Neil Abercrombie files a brief with the Ninth Circuit supporting the request made by Lambda Legal, the group spearheading the Sevcik marriage equality challenge in Nevada, to place that case and a marriage equality case out of Hawaii called Jackson on a parallel schedule at the circuit court.
In the brief, Abercrombie writes that he “affirmatively supports the Sevcik motion filed in the Sevcik appeal on the understanding that [he] will be free to file his own separate briefs in the Jackson appeal, if he so chooses.” Abercrombie’s brief specifically notes that the request made by Lambda Legal is not a consolidation of the appeals, but rather a parallel briefing and argument schedule that would allow the two challenges to be heard and decided upon by the same appellate panel.
