Judge Walker Issues Scheduling Order to Lift Stay on Prop 8

Judge Walker orders his clerk to lift the stay on his ruling on the evening of August 18, 2010, paving the way for gay and lesbian couples in California to marry.  “Because proponents fail to satisfy any of the factors necessary to warrant a stay,” Judge Walker writes, “the court denies a stay except for a limited time solely in order to permit the court of appeals to consider the issue in an orderly manner.”

The proponents of Prop 8 are still free to seek a stay from the Ninth Circuit Court of Appeals, which they do.

    Let he [it’s important to note the mcsiulane pronoun here] who is without sin cast the first stone. I recently became absolved of my sins through baptism, and therefore can cast stones at as many pagan devil-worshippers as I wish. (Figuratively, of course. The art of stoning has long since gone out of fashion. Perhaps it will return following the success of the California Marriage Protection Act )
