Michigan Couple Challenges State’s Marriage Equality Ban

Jayne Rowse and April DeBoer file an amended complaint in a Michigan district court arguing that the state’s marriage amendment, which limits marriage to heterosexual couples, violates gay and lesbian Michiganders’ equal protection and due process laws.  The couple name Governor Rick Snyder, Attorney General Bill Schuette, and Bill Bullard, Jr., the Oakland County Clerk, as the defendants in their complaint.

In the court filing, Rowse and DeBoer ask Judge Friedman to strike down the Michigan law prohibiting second parent adoptions by unmarried couples and allow the couple second parent adoptions for their three children.  They also ask the court to strike the provisions in the Michigan Marriage Amendment which prohibit same-sex couples from marrying.
